Flooency — Terms of Service & Privacy Policy

1. Introduction

Welcome to Flooency. These Terms of Service and Privacy Policy ("Terms") govern your use of the Flooency keyboard app for iOS and iPadOS, the Flooency desktop app for macOS, and any related services (collectively, the "Service"). The Service is provided by Flooency ("we," "us," or "our").

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.


2. Description of Service

Flooency is a text improvement and translation tool available as a keyboard extension for iOS/iPadOS and as a desktop application for macOS. The Service allows you to improve, rephrase, and translate text using third-party artificial intelligence providers that you configure with your own API keys.


3. Eligibility

You must be at least 13 years of age to use the Service. If you are under the age of 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements.


4. Your Account and API Keys

The Service does not require you to create an account with us. To use the AI-powered features, you must provide your own API key from a supported third-party AI provider (currently OpenAI or Anthropic).

You are solely responsible for:

  • Obtaining and maintaining valid API keys from your chosen AI provider.
  • All charges incurred through the use of your API keys, including any charges imposed by the third-party AI provider.
  • Keeping your API keys secure. We store your API keys locally on your device and never transmit them to our servers.
  • Complying with the terms of service of your chosen AI provider.

5. Acceptable Use

You agree not to use the Service to:

  • Generate, improve, or translate content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
  • Violate any applicable local, state, national, or international law or regulation.
  • Infringe upon the intellectual property rights of any third party.
  • Generate spam, phishing content, malware, or other malicious material.
  • Attempt to reverse-engineer, decompile, or disassemble the Service.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Circumvent any technical limitations or restrictions of the Service.

We reserve the right to terminate or suspend your access to the Service at our sole discretion if we believe you are in violation of these Terms.


6. Intellectual Property

Our Rights

The Service, including its design, code, features, and documentation, is owned by Flooency and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service except for the limited license to use it as described herein.

Your Content

You retain all rights to the text you input into the Service ("Your Content"). We do not claim ownership of Your Content. By using the Service, you acknowledge that Your Content may be transmitted to third-party AI providers as described in Section 11 of these Terms.

Output

Text generated or modified by the Service using third-party AI providers ("Output") is subject to the terms of the applicable AI provider. We do not claim ownership of any Output generated through your use of the Service.


7. Fees and Payments

The Service itself is currently provided free of charge. However, you are solely responsible for any costs associated with:

  • Your API keys and usage charges from third-party AI providers (OpenAI, Anthropic, or others).
  • Internet connectivity required to use the Service.
  • Any applicable taxes.

We reserve the right to introduce paid features, subscriptions, or other pricing in the future. Any such changes will be communicated to you in advance.


8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
  • THE RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE, RELIABLE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.
  • ANY OUTPUT GENERATED BY THIRD-PARTY AI PROVIDERS THROUGH THE SERVICE WILL BE FREE OF ERRORS, BIAS, OR INACCURACIES.

You acknowledge that AI-generated content may contain errors, inaccuracies, or biased output, and you are solely responsible for reviewing and verifying any Output before relying on it.


9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FLOOENCY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.


10. Indemnification

You agree to indemnify, defend, and hold harmless Flooency and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any rights of any third party.
  • Your Content or any Output generated through your use of the Service.

11. Privacy Policy

Overview

Flooency is designed with privacy as a core principle. We do not operate servers or backend services. We do not collect, store, or transmit your personal data to ourselves or any third party (other than the AI providers you configure, as described below).

Information We Do Not Collect

  • We do not collect personal information such as your name, email address, or contact details.
  • We do not use analytics, tracking, or advertising frameworks.
  • We do not use crash reporting services.
  • We do not create user accounts or profiles.
  • We do not track your usage behavior.
  • We do not sell, rent, or share any user data.

Information Stored Locally on Your Device

The Service stores the following data locally on your device only. This data never leaves your device except as described under "Third-Party AI Services" below.

  • API Keys: Your self-provided API keys for third-party AI services are stored locally on your device using standard platform storage mechanisms. These keys are never transmitted to us.
  • History: The Service maintains a local history of your recent text improvement and translation operations (up to 100 entries), including the original text, the result, the selected language, tone, and timestamp. This history is stored entirely on your device.
  • Preferences: Your settings, such as selected language, AI provider, and tone, are stored locally on your device.

You can clear your history and remove your API keys at any time from within the Service.

Third-Party AI Services

When you use the Service to improve or translate text, the text you enter is sent directly from your device to the third-party AI service you have configured:

  • OpenAI (api.openai.com) — if you select OpenAI as your provider
  • Anthropic (api.anthropic.com) — if you select Anthropic as your provider

This transmission occurs only when you actively initiate an improve or translate operation. The text is sent directly from your device to the provider's servers using your own API key over an encrypted HTTPS connection. We do not have access to this data, do not act as an intermediary, and do not log or store any of the transmitted data.

We encourage you to review these policies to understand how your data is handled by the AI provider you choose.

Keyboard Extension (iOS/iPadOS)

The Flooency keyboard extension requires network access to communicate with the AI service you have configured. The keyboard extension:

  • Only processes text when you explicitly initiate an improve or translate action.
  • Does not log keystrokes.
  • Does not monitor, collect, or transmit text you type in other apps unless you explicitly invoke the Flooency improve or translate features.
  • Communicates with the main Flooency app only through a local, on-device app group for the purpose of storing your settings and history.

Data Security

  • All communications with third-party AI services use HTTPS encryption.
  • All app data is stored locally on your device using standard platform storage mechanisms.
  • We do not operate servers and do not store any of your data remotely.

Your Data Rights

Since we do not collect or store any personal data on our servers, there is no personal data for us to access, modify, export, or delete on your behalf. All data is stored locally on your device and is under your full control. You can delete all app data at any time by uninstalling the Service or clearing the app's data through your device settings.

Rights for Users in the European Economic Area, United Kingdom, and Switzerland

If you reside in the EEA, UK, or Switzerland, you have rights under the General Data Protection Regulation (GDPR) including the right to access, rectify, erase, restrict processing, data portability, and object to processing of your personal data. Because we do not collect or store personal data on our servers, these rights are effectively self-service — all your data resides on your device and is under your control.

Rights for California Residents

If you are a California resident, the California Consumer Privacy Act (CCPA) grants you specific rights regarding your personal information. We do not sell personal information. Because we do not collect or store personal data on our servers, your rights under the CCPA are effectively self-service — all your data resides on your device and is under your control.


12. Children's Privacy

The Service is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe that a child under 13 has provided personal information through the Service, please contact us and we will take steps to address the situation.


13. Third-Party Links and Services

The Service may contain links to third-party websites or services that are not owned or controlled by Flooency. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we are not responsible or liable for any damage or loss caused by or in connection with the use of any such third-party content, goods, or services.


14. Termination

We may terminate or suspend your access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.


15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through the courts of competent jurisdiction in the State of New York.


16. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Last Updated" date at the top of this document. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.


17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.


18. Entire Agreement

These Terms constitute the entire agreement between you and Flooency regarding the Service and supersede all prior agreements and understandings, whether written or oral, regarding the Service.


19. Waiver

The failure of Flooency to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Flooency.
